The text now allows ESMA itself, acting on the request of at least one competent authority, to conclude cooperation arrangements with third-country supervisory authorities, alongside the competent authorities of the Member States, and it adds that arrangements shall not be concluded with a third country listed in Annex I to the EU list of non-cooperative jurisdictions for tax purposes in addition to the existing anti-money-laundering list exclusion.
Paragraph 3 changes the wording so that the professional-secrecy guarantee requirement is phrased as arrangements 'may be concluded only where' the condition is met, and the reference to the tasks performed shifts from being those of the competent authorities to being those of the supervisory authorities.
Paragraph 4 no longer provides for regulatory technical standards developed by ESMA and adopted under Regulation (EU) No 1095/2010, and instead empowers the Commission to adopt delegated acts under Article 44 to supplement the Regulation by setting the minimum content and template for the cooperation arrangements.
