Throughout the article, references to "eligible liabilities" have been replaced with the term "bail-inable liabilities" in the sections covering the resolution scheme, the concentration limit instruction, the exclusion mechanism, the Fund contribution rules and the valuation assessment.
A new exclusion at point (f) has been extended to also cover liabilities to CCPs authorised in the Union or recognised third-country CCPs, and a new point (h) has been added excluding liabilities to certain non-resolution-entity group members from write-down or conversion, subject to a stated exception and a Board assessment tied to Article 12g(2).
A new subparagraph has been added to paragraph 5 requiring the Board to carefully assess whether liabilities to such non-resolution-entity group members that are not already excluded under the new point (h) should be excluded or partially excluded under the existing exclusion criteria.
